Current fishing regulations: catch rates, gear requirements and penalties for non-compliance

Laws and regulations of state bodies regulate the rules and requirements for each method of fishing. Their observance is necessary to maintain the ecological balance in water bodies, to preserve the volume of fish. Fishing rules were created for each type of fishing, most of them adapted to a specific fishery basin.

Code of laws and regulations

General rules are described in the new fishing law - 166-FZ. Specific fishing rules are specified in article 43.1. There are prescribed types of fishing, standards and terms, restrictions and the maximum allowable volume of production, fines. This recreational fishing law applies to both legal entities and individuals. Fishing activity is regulated by other acts.

In addition, there are regional documents:

  • No. 293. Reservoirs of the Azov-Black Sea basin.
  • No. 283. It regulates the catch of fish on the territory of Lake Baikal.
  • No. 347. The document applies to water bodies of the East Siberian basin.
  • No. 385. This fishery law regulates the amount of catch and what you can fish for in the waters of the Far Eastern farms.
  • No. 13. Defines a fishing ban and a fishing permit for the Northern region of the Russian Federation;
  • No. 453. Regulates when it is possible to carry out non-commercial fishing in the Volga-Caspian fishery facilities.
  • No. 393. The document determines from what date and what you can fish in the ponds, rivers and lakes of the Western region.
  • No. 319. Establishes the rules for harvesting and the permitted volume of fish caught in a certain period in the West Siberian territory.

Fishing places and its types

Fishing regulations divide water bodies into two types - common use and cultural fish farms. In the latter, you can get an object of sport fishing, but it is necessary to obtain a fishing license. Mining in them is carried out on a paid or free basis. Vouchers can be issued to members of specialized societies, which entitles them to preferential conditions.

Currently, there are the following types of fishing:

  • Amateur. The main sign is that the production will not be used as an object of sale in the future. Each region determines what you can fish for, a ban on activities during the spawning period.
  • Sports. The goal is to catch fish of a certain species with maximum weight and size. To do this, they go to the object of sports fishing, a permit is issued in advance, a fishing ticket, a regulation is drawn up on the basis of current legislation.
  • Trade. Feature - commercial component. The fish is on sale. The type of prey is determined - red, white or black. After issuing a license, a ban on fishing for other types of fish is automatically in effect. At the same time, it is allowed to catch a permissible minimum amount of a type of fish that is not specified in the license.

These types of fisheries also differ in the periods of prohibition of activities, fishing rules and gear used. They are described on the website of the Federal Agency for Fishery, but it is recommended to check the details at the local branch of the organization.

Fishing times and prohibited tackle

In most cases, spawning is prohibited. Each region sets certain dates, most often it is spring and winter. Special restrictions apply to spearfishing - the ban on fishing lasts longer than traditional methods of extraction.

However, there are exceptions - you can plan fishing without a catch rate in certain places. These include CHP channels, lock chambers, in areas located at a distance of up to 500 m from the dams. These places accumulate a large amount of potential production. It is possible to fish there during the ban, but in some cases a fishing permit is required.

For recreational fishing, there are restrictions on gear:

  • fishing on the net in any form is prohibited;
  • the use of special traps, with the exception of crayfish;
  • extraction for gum in those rivers and reservoirs where salmon breeds are found;
  • you need to know how many hooks are allowed - up to 10 pcs. on the lines for 1 person;
  • bottom seines and trawls of all designs;
  • unauthorized devices using hooks;
  • scoops or lifts, whose dimensions exceed 1 * 1 m, and the cell pitch is more than 10 mm;
  • traps;
  • piercing objects - spears, harpoons.

Illegal fishing methods

There is a general ban on certain methods of fishing. The defining feature is the violation of the local ecological system, a large one-time production volume. In addition to the fact that it is impossible to fish in the spring and during the spawning period, the described methods cannot be used.

These include the following:

  • use of sweeps and highlights for spearfishing;
  • jamming with explosives, electrical devices;
  • trolling on a boat with a sail or a motor with more than two lures;
  • organization of dams;
  • fishing with the use of vents (circles), if the number of hooks exceeds 10 pcs. for one fisherman;
  • catching fish by the method of lowering the reservoir;
  • installation of structures such as a hut on ice;
  • fishing from a boat during spawning is not allowed;
  • there is a ban on fishing with firearms or pneumatic weapons.

In order to fish from a boat, you must register the boat. You also need to issue a fishing ticket for extraction in special ways, in particular - spearfishing.

Catch rates

The law regulates the maximum allowable mass of prey. For members of the Society of Hunters and Fishermen, it is 5 kg, for all others - 3 kg. This is the daily norm, but if staying on the reservoir takes more than 24 hours, it is allowed to exceed the norm twice. A list of prohibited species has been compiled for each fishery.

Additionally, the following characteristics are taken into account:

  • the minimum allowable size is regulated for each type of fish;
  • weight.

If these parameters are less than acceptable, the prey should be released into the habitat with minimal damage. Most often, these norms are indicated in the permit for fishing, in the permit for spearfishing. As an example, it is recommended that you familiarize yourself with the data in the table, which indicates the permitted species of fish.

To measure the length of crustaceans, one should take the distance from the eyes to the end of the tail plates. This applies to crayfish, catching crabs in Russia is prohibited for amateurs.

Fines

In addition to the fact that there is a ban on fishing during a certain period and on specific types of potential prey, penalties can be applied in case of violation. Compliance with the rules is monitored by state inspectors who can audit the volume of fish, analyze the legality of using certain gear or fishing methods.

For non-compliance with the above rules, one of the following penalties may apply:

  • Fines, the amount of which varies from 2,000 to 5,000 thousand rubles. Additionally, a swimming facility, gear, catch may be confiscated. This is a penalty for catching fish with nets or other prohibited means. The basis for these actions is Article 8.37, Part 2 of the Code of Administrative Offenses of the Russian Federation.
  • Criminal liability arises if material damage in excess of 100 thousand rubles has been caused to the state or a private organization. At the same time, an automatic ban on fishing occurs, it is possible to issue penalties in the amount of up to 1 million rubles, as well as imprisonment for up to 5 years. The basis is Article 256 of the Criminal Code of the Russian Federation.

Fish supervision employees are given the authority to ban fishing in a particular place, check documents, equipment and catch. They can deliver offenders to representatives of law enforcement agencies, write protocols on the spot.

The catch and the above rules should be taken as seriously as possible. Otherwise, not only the pleasure of fishing will be lost, but also the catch and tackle.
